OHS issues from over the horizon

seaOn 18 March 2015, the Melbourne office of Herbert Smith Freehills conducted a breakfast seminar that doubled as a launch for the latest edition of the CCH Wolters Kluwer book Australian Master Work Health and Safety Guide (reviewed recently).  The seminar had three of the book’s authors talking about emerging occupational health and safety (OHS) and work health and safety (WHS) issues for Australia.  These included

  • The growth of WHS/OHS “Assurance Programs”
  • The potential implications for the safety management from the Trans-Pacific Partnership and Free Trade Agreements.
  • The OHS trend in the European Union for “Supply Chain Safety“.

The first two of these topics are discussed below.

New book on pipeline safety has OHS lessons for all

Hopkins Hayes Book CoverAny new book by Andrew Hopkins is a cause for excitement.  The latest book co-written with Associate Professor Jan Hayes* focusses, primarily, on two pipeline disasters in the United States but has sufficient information and thoughts for those OHS professionals outside this sector and jurisdiction.

Nightmare Pipeline Failures: Fantasy planning, black swans and integrity management” is a typically slim volume written in Plain English that benefits from the broad knowledge of its authors.  Readers of Hopkins’ early books will get all of the cross-references.  In some ways, this book can be seen as almost a case-study of Hopkins’ work on mindfulness and high-reliability organisation, as the themes of management perspectives, activity and decision-making occur repeatedly in this book. Poor editing could increase confusion on workplace bullying

One of the occupational health and safety (OHS) issues that does not “travel” well across international borders is workplace bullying.  Each country usually has its own laws (if at all).  Each operates in a different culture and each has a different definition of what constitutes workplace bullying.  Those who communicate and publish information on this hazard need to be sure that an article is relevant to its readership or at least clearly indicate the article’s overseas origin.

The safety features of the new Polaris set a new benchmark

2014.5-SprtsmnAce4x4-White_f3qThe Weekly Times scored an exclusive this week about a new model of Polaris quad bike which incorporates a roll cage or rollover protection structure (ROPS) in its design.  The significance of the Sportsman Ace is, according to the newspaper and the manufacturer, a “game changer” because it seems to counter the arguments of the quad bike manufacturers against such design changes in submissions to government and in public campaigns.  They have stressed that more effective control of a quad bike comes from driver training and behaviour and that ROPs may itself contribute to driver injuries and deaths.  The Polaris Sportsman Ace, to be released in the United States this week and Australia next month, seems to prove that quad bikes can be redesigned to include safety features, an action that manufacturers have been extremely reluctant to do.

A major critic of ROPs on quad bikes in Australia has been the Federal Chamber of Automotive Industries (FCAI). Quad bike fatalities cost an average of at least $2.3 million

Australian research has provided an important additional element to discussions on the safety of using quad bikes as work vehicles on Australian farms.  According to a media release to be published on 3 April 2013 from the Australian Centre for Agricultural Health and Safety (ACAHS):

Two new papers released today in the Australian and New Zealand Journal of Public Health ….indicate that the costs for fatal [quad bike] incidents between 2001-2010 were $288 million.” [links added, articles only available for purchase or by subscription]

 ““This conservative estimate draws on deaths data from the National Coroners Information System and includes projected losses in future earnings, impacts on household contributions, insurance payments, investigation and hospital costs”…. The average cost was $A2.3 million, with the highest average being in those aged 25-34 years at $A4.2 million””.

CSB pushes for a more effective discussion on fatigue management

Occupational health and safety has many examples of addressing small or short-term issues rather than  facing the difficult and hard, but more sustainable, control measures. I was reminded of this by a recent media statement from the United States Chemical Safety Board (CSB) in relation to fatigue management.

In 2007 the CSB recommended that, following the Texas City refinery fire,

“the American Petroleum Institute (API) and the United Steelworkers International Union (USW) jointly lead the development of an ANSI consensus standard with guidelines for fatigue prevention in the refinery and petrochemical industries.” [links added]

The progress of API and USW in developing the 2010 ANSI-approved Recommended Practice 755 (RP 755) has been reviewed by the CSB staff and they have found the following disturbing problems:

  • “The document was not the result of an effective consensus process, and therefore does not constitute a tool that multiple stakeholders in the industry can “own.” It was not balanced in terms of stakeholder interests and perspectives, and did not sufficiently incorporate or take into account the input of experts from other industry sectors that have addressed fatigue risks. Social media manipulation of OHS statistics

Recently SafetyatWorkBlog criticised the focus on fatality statistics as a measure of success. Workplace fatalities are a convenient measure but can seriously misrepresent the status of workplace safety by ignoring psychosocial hazards and occupational illnesses. An infographic came through the SafetyAtWorkBlog inbox this weekend which illustrates the unhelpful obsession with fatalities but, perhaps more importantly, the risks of social media.

OSHA-edited-v5This infographic from US firm Compliance and Safety (purposely unlinked) is slickly produced for social media and blogs but is fundamentally invalid. The title at the top is a ridiculous comparison. “Is OSHA a wasteful regulatory nightmare or common sense that saves lives?” The Occupational Safety and Health Administration (OSHA) may be wasteful but how can this be compared to the amorphous and self-serving concept of “common-sense”? The implication is that common sense equates to a free-market regulation of workplace safety. The failure of the free-market approach to occupational safety, and to the environment, many decades ago is exactly the reason why regulations were introduced.
